Client Responsibilities

Clients are responsible for providing accurate and timely information necessary for AMZ HAWK to perform its services. AMZ HAWK is not responsible for losses caused by inaccurate or incomplete information supplied by the client.

Amazon Policies

Clients remain responsible for compliance with Amazon’s policies, marketplace rules, product requirements, advertising requirements, and seller obligations.

AMZ HAWK may provide recommendations regarding Amazon compliance but cannot guarantee that Amazon will approve a listing, advertisement, account, product, claim, or submission.

Amazon may modify its policies, algorithms, advertising systems, fees, or marketplace requirements at any time.

Account Access

Where necessary, clients may provide AMZ HAWK access to Seller Central, Vendor Central, Amazon Advertising, analytics platforms, or other business systems.

Access will be used only for purposes related to the agreed services. Clients remain the legal owner and administrator of their accounts unless otherwise agreed in writing.

Fees and Payments

Service fees, payment schedules, retainers, setup fees, advertising management fees, or other charges will be stated in the applicable proposal, agreement, invoice, or order.

Unless otherwise agreed in writing, payments are due according to the terms stated on the applicable invoice or service agreement.

Third-party expenses including Amazon advertising spend, software subscriptions, shipping, sourcing, photography, creative production, inventory, Amazon fees, and other external costs are the responsibility of the client unless expressly included in the service agreement.

Advertising Budgets

Advertising spend is separate from AMZ HAWK’s management fees unless specifically stated otherwise.

Clients are responsible for maintaining sufficient funds and approved payment methods for their advertising accounts.

AMZ HAWK may recommend advertising budgets but cannot guarantee the revenue or profitability generated from those budgets.

Intellectual Property

Unless otherwise agreed in writing, AMZ HAWK retains ownership of its proprietary methodologies, templates, systems, processes, frameworks, internal tools, and know-how.

Upon full payment, clients may use final deliverables created specifically for their business according to the terms of the applicable service agreement.

Client-owned trademarks, product images, account data, listings, business information, and other materials supplied by the client remain the property of the client.

Confidentiality

AMZ HAWK will take reasonable steps to protect confidential information supplied by clients.

Clients also agree not to disclose AMZ HAWK’s confidential strategies, proprietary documents, internal processes, or non-public materials without authorization.

Third-Party Services

AMZ HAWK may use or recommend third-party services such as Amazon, GoHighLevel, Google, Meta, analytics software, keyword research tools, communication platforms, payment processors, and other software providers.

AMZ HAWK is not responsible for outages, policy changes, data loss, account suspensions, billing issues, or other actions caused by third-party platforms.

SMS Communications

Customers who voluntarily opt in may receive SMS communications from AMZ HAWK regarding appointment reminders, consultations, service updates, support, or related communications.

Message frequency may vary. Message and data rates may apply. Reply STOP to opt out and HELP for assistance. Consent to receive SMS messages is not a condition of purchasing services.

Cancellation and Termination

Cancellation, notice periods, refunds, and termination rights will be governed by the specific service agreement or package purchased by the client.

  • Payments are overdue
  • Required access is removed
  • The client engages in unlawful or fraudulent activity
  • Continuing the relationship would violate Amazon or other platform policies
  • The client materially breaches an agreement

AMZ HAWK may suspend or terminate services in circumstances including those listed above.

Limitation of Liability

To the maximum extent permitted by applicable law, AMZ HAWK will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services, including losses related to the matters listed below.
